Threat to Shut Down MLSR - No More Real Salt Lake Coverage

You as an MLSR reader are fairly intelligent, well informed and aware that there are those who do not like us for one reason or another.

Today we received an email from the guy who runs the "Keepin' it Real" Real Salt Lake fan site. In the series of emails he alleges that we have violated his copyright for posting the photo someone emailed us of fans at RSL's last game at Rice-Eccels Stadium.

We removed the photo and the post containing it as well as another photo someone sent to us which they thought was a picture of Jared Borghetti which supposedly this guy owned.

We further asked that he make us aware of any other infringements to his copyrights so that we could remove them. He declined and instead threatened to send Google a DMCA takedown notice.

We have been in constant contact with Google throughout this and have taken steps to insure that we are within the law as a news and information site protected under the Fair Use doctrine.

Should you experience any outage of our site we ask that you hold tight while we resolve the matter to Google's satisfaction.

He asserts...


"The owner of your site is responsible for verifying that your site has ownership rights to ALL content on the site. NO EXCUSES. You are reponsible [sic], no matter how many contributors you have. If you received the content through an outside source it is your responsibility to verify ownership."


Which of course would make it impossible for us to publish anything sent to us anonymously with no provenience. That is if it were true....which it isn't. News sites are explicitly protected under Fair Use.

"I do have a responsibility to defend my ownership (or have it subject to Fair Use provisions) which I am clearly doing in this case with your site and with others."



You should also note that this man proudly asserts he is the one who had RSLFM taken down.

For that reason, we find that covering RSL related news to be too risky. We will still report any transfer rumors involving RSL beyond that, nothing.

Sorry RSL supporters, you can thank realsaltlakefan at the keeping it real" blog for that. In an effort to monopolize any and all RSL news and rumor he is having competing sites shut down by sending false DMCA takedown notices to Google after content is removed. RSLFM talked about this, now he is after us.

    An analogy: If you buy a diamond ring from someone, even in a jewelery store, and it was later discovered to be one stolen a few months before, then that doesn't absolve you of ownership of stolen property. You won't be prosecuted if innocent recipient, but you will have to return it nevertheless.

    In the case here, if you get material that is not owned by the person who sent it to you, or owned by you, then you are using stolen property. Period.

    Fair use does not allow a newspaper to print something that someone else wrote without providing compensation.

    Same rules apply to you.

  10. Is the guy from "Keepin' It Real" fighting MLS Rumors because you had the story on Rio Tinto Stadium's naming rights posted on the same day with more proof, while he actually sited his original source from the thread of another website?

    If his rules were correct, BigSoccer could shut him down for stealing their content lol

    Just this weekend I heard that a TFC fan accidentally bumped into a Houston fan and didn't say 'excuse me'. This went unnoticed by the mainstream media, but I'm sure that MLSR will call it out for hooliganism that it clearly is. The league clearly needs to step in and shut down all this rampant hooliganism.

  37. Asking to have the pictures that he owns is not outside his realm of asking. He has a right to ask them to take them down, unless MLSR get his permission to use them. The whole shut down the website thing, though, is just laughable.

  41. What a moron. I encourage all loyal MLSR fans to boycott the "Keepin it Real" blog. Perhaps when his visitorship declines by 30% he will realize his trivial threats and scare tactics are counterproductive.

    I mean, seriously. The "Keepin It Real" RSL blog? Who the $%&* cares what they think. Does anyone actually read that blog, or consider them an authority on ANYTHING?

    They are non-players in the world of soccer blogs, and I encourage MLSR to not bow to this little man's pressure.

  47. Since the man in who initiated all of this now makes the claim that we 'made up' things and since he has already been identified by someone else we decided to show the entire saga of emails. You can judge for yourselves.

    The diamond store analogy is ludicrous. No one stole anything. We linked to an image. Get it straight. We showed an image he hosted.

    That is considered an 'inline image' and contrary to what he believes, there have been no definitive rulings on that one way or the other. The largest court case involving that was kicked back down to a lower court.

    And regarding your analogy mr. anonymous or rather mr realsaltlake fan [tracking is great]...

    In your analogy we didn't 'steal' the diamond, showed a web cam of the diamond on our mobile.

    Thats no more 'stealing' than a camera 'steals your soul'...

    Though we're sure there likely are some folks who still believe THAT as well.

    Nevertheless we removed your image of RSL fans lighting off a lone smoke bomb and the training session with the guy who was NOT Borghetti...

    If linking to other web hosted images is theft, then the majority of all web sites and their owners should be charged. And like he said, courts are very wary when it comes to applying American tangible property laws (like the diamond ring example) to intellectual property in an international entity like the Internet. In fact, this continues to be one of the more controversial legal topics in the 21st Century and is nowhere near a definitive resolution.

    Keep up the good work MLSR - you know you're doing a good job when people take time out of their lives to hate on you.

  51. Wow!!! sounds like the dude in SLC has way too much time on his hands. Rather than wanting to positively promote his team and MLS through as many channels as possible he just simply made himself look like a blow-hard fool and probably turned off more fans to the American game.

  60. I would agree with TJ that nobody cares about a pissing match between blogs, but the problem is that one of the bloggers decided to start the pissing match anyway.

    As a blogger, I'm well aware of my own 'crack in the wall' that I'm trying to make for myself and do not have delusions of grandeur that I need to muscle someone else for using a picture. Was it that guy's picture? Did he take it himself/herself?

    I don't see the big deal. If we're not making any money off this, what's the problem?

  66. I am a real salt lake fan who used to visit rslfm frequently and there material was useful but most likely a severe copyright infringement. I find mlsr to be one of the best mls soccer blogs on the net for mls coverage and i think it is ridiculous that this is just a sign of a stupid photographer who is convinced his poorly lit and angled pictures are actually worth being copyrighted

  70. I will boycott that site. I'm an avid RSL fan and season ticket holder. RSLFM was an amazing website, and knowing that he had it shut down angers me more. RSLFM was way better than his site was. Booooo. We're all soccer fans. Can't we help each other out and not act like children?

    If you want photos, you can use any on my blog and if you need specific photos from RSL, just let me know and I will work to get you copies.

    There are a couple people trying to make money off the whole soccer fan blog thing, I sure as hell am not one of them. So anything I have is yours to use.
